Insurance & Liability Clause

Pet Getaway – Home Dog Boarding

1. Insurance Cover

Pet Getaway maintains appropriate business insurance, including:

• Public Liability Insurance

• Care, Custody & Control cover

• Professional indemnity (where applicable)

Insurance certificates are available for inspection upon request.

2. Standard of Care

Pet Getaway agrees to:

• Exercise reasonable care and skill

• Follow written policies and procedures

• Operate in accordance with licensing requirements

• Prioritise the welfare and safety of all dogs

Dogs are cared for in a structured home environment under supervision.

3. Owner Responsibility

Owners remain responsible for:

• Accurate disclosure of health conditions

• Accurate disclosure of behavioural history

• Ensuring vaccinations are current

• Informing us of any risks or concerns

Failure to disclose relevant information may invalidate liability protection.

4. Pre-Existing Conditions

Pet Getaway is not liable for:

• Pre-existing medical conditions

• Undiagnosed health issues

• Age-related illness

• Natural causes

• Stress-related digestive upset (unless caused by negligence)

Owners accept that changes in environment may occasionally cause mild temporary stress symptoms.

5. Dog Interaction

Dogs are cared for in a home environment and may:

• Interact socially

• Engage in supervised play

• Share garden space (under supervision)

Minor scratches or superficial injuries may occasionally occur during normal play.

Pet Getaway shall not be held liable for minor injuries arising from appropriate social interaction unless caused by negligence.

6. Emergency Veterinary Treatment

In the event of illness or injury:

• Pet Getaway will attempt to contact the owner immediately

• Veterinary treatment will be sought where necessary

• Owners agree to cover associated costs

Pet Getaway will not delay urgent treatment due to inability to contact the owner.

7. Escape

Pet Getaway maintains secure fencing and controlled entry procedures.

However, we cannot accept liability for escape where:

• A dog exhibits unforeseen behaviour

• Inaccurate behavioural disclosure was provided

• Reasonable security measures were in place

All escape incidents are documented and reviewed.

8. Limit of Liability

Nothing in these Terms excludes liability for:

• Death or personal injury caused by negligence

• Fraud or misrepresentation

• Any matter which cannot be excluded under UK law

Where liability is established, it shall be limited to:

• The cost of veterinary treatment directly attributable to proven negligence

• Or the total value of the boarding contract (whichever is higher)

9. Indemnity

Owners agree to indemnify Pet Getaway against:

• Claims arising from undisclosed behavioural history

• Damage caused by their dog to third parties

• Legal claims resulting from inaccurate information provided

10. Governing Law

This agreement is governed by the laws of England and Wales.
